1. Introduction

Welcome to HomeTeams Integrated Health (“HomeTeams,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our Immediate Care services, including our website, web app and mobile application, member platform, nurse triage line, AI support features, and any related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must discontinue using our Services. We reserve the right to modify these Terms at any time. Any changes will be effective when posted on our website or mobile application. Your continued use of the Services after the posting of revisions constitutes your acceptance of such changes.

2. Eligibility

Age Requirement: You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Services. If you are under the age of 18, a parent or legal guardian must register on your behalf. Legal Capacity: By using the Services, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.

3. Nature of Services

Non-Emergency Care:The Services provided by HomeTeams are for non-emergency, immediate care only.IF YOU EXPERIENCE A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY DEPARTMENT IMMEDIATELY.Not Insurance: The Services, including memberships, donotconstitute health insurance or a substitute for insurance. Membership fees cover access to certain telehealth services but do not replace primary care services, specialist consultations, or hospital care.Third-Party Providers: We partner with third-party providers (e.g., 24/7 nurse call centers, AI platforms, telehealth professionals, e-commerce providers) to deliver certain aspects of the Services. While we strive to partner with reputable providers,we do not control the services or operations of these third partiesand are not responsible for their actions or omissions.

4. User Accounts

Registration: To use certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately if you suspect any unauthorized use of your account or any other breach of security.Account Termination: We reserve the right to suspend or terminate your account if you violate any provision of these Terms or if we suspect fraudulent, abusive, or unlawful activity.

5. Membership and Fees

Membership Plans: We offer various membership plans (e.g., Basic, Plus, and Premium) with corresponding fees. Details of each plan’s benefits, limitations, and pricing can be found on our website or marketing materials.Payment: Membership fees are billed on a recurring monthly basis unless otherwise stated. By signing up for a membership, you authorize us to charge your designated payment method for the applicable fees.Pay-Per-Use Calls: Non-members (or members who opt not to use membership services) may choose to pay per call for nurse triage or other telehealth services at the published rate (e.g., $49/call).Cancellations and Refunds: You may cancel your membership at any time by logging into your account on the website. In the unlikely event a problem persists, please contact us. Refunds, if applicable, will be provided in accordance with our then-current refund policy stated on our website.

6. Telehealth and AI Services

Telehealth: Our Services may include telehealth consultations, nurse triage, and other virtual healthcare interactions.All telehealth providers are licensed, where required, and bound by professional and ethical obligations.However, telehealth may not be appropriate for all medical conditions. You acknowledge that it is your responsibility to seek in-person care when needed.AI Support: We may use artificial intelligence (“AI”) tools to provide follow-ups, reminders, and preliminary triage advice.AI does not replace professional medical judgment.Always consult a qualified healthcare professional for personalized advice and treatment.

7. Use of the Services

Prohibited Conduct: You agree not to use our Services for any unlawful or abusive purpose. You shall not attempt to gain unauthorized access to our systems or any user accounts, transmit any viruses, or engage in any activity that disrupts our Services.Reliance on Content: While we strive to provide accurate health information, any health-related content on our platform is for general informational purposes and isnota substitute for professional medical advice.Appointment Availability: Same week appointments are not guaranteed and will be provided based on the availability of service providers.PC Discounts: Discounts offered at the PC are subject to change at the PC’s good faith discretion.

8. Intellectual Property

Ownership: HomeTeams and its licensors own all intellectual property rights in the Services, including text, graphics, logos, and software.License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.

No Medical Advice Warranty: The Services are provided on an “AS IS” and “AS AVAILABLE” basis. We make no representations or warranties regarding the completeness, accuracy, or reliability of medical or health information provided.Limitation of Liability: To the fullest extent permitted by law, HomeTeams and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Services.Indemnification: You agree to indemnify, defend, and hold harmless HomeTeams from any claims, damages, or expenses arising out of your use or misuse of the Services or your breach of these Terms.

10. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of the state of Washington in which HomeTeams is headquartered, without regard to conflict of law principles.Dispute Resolution: Any dispute arising under these Terms shall be resolved by binding arbitration in accordance with the rules of a recognized arbitration organization. Each party shall bear its own costs unless otherwise required by law.

11. Termination

We may terminate your access to the Services, in our sole discretion, if you breach any provision of these Terms or engage in conduct that we believe is unlawful or harmful. Upon termination, all rights granted to you under these Terms will cease immediately.
